Acceptance of These Terms

Throughout these Terms, “Everside Collective,” “we,” “us” and “our” refer to the operator of eversidecollective.shop. “You” and “your” refer to any visitor, customer or other person who accesses or uses the website.

These Terms apply to all website visitors and customers, including users who browse products, submit forms, create accounts, purchase products, provide reviews or communicate with customer care.

Our store is hosted on Shopify, which provides the ecommerce platform that allows us to offer products and services online. Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and privacy documentation.

Eligibility and Lawful Use

By using the website, you represent that you are legally capable of entering into a binding agreement in your jurisdiction. If you are below the applicable age of majority, you may use the website only with the involvement and permission of a parent or legal guardian.

You may not use the website or our products for an unlawful, fraudulent or unauthorized purpose. You must comply with all laws that apply to your use of the website and your purchase, import and use of products.

Products and Product Information

Everside Collective offers decorative pet accessories, which may include pet bandanas, neck scarves, bibs, lace collars, bows, neckties and other styling accessories. Product availability may change without notice.

We make reasonable efforts to display product descriptions, dimensions, materials, colors and photographs accurately. However, the appearance of colors may vary because of device settings, lighting, photography, fabric batches and production differences.

Pattern placement, stitching, bow shape, lace alignment and other hand-finished details may vary slightly between individual pieces. Reasonable variations that do not materially affect the intended use of the product are not necessarily defects.

Measurements are provided as a shopping guide. Because pet breeds, body shapes, coat thickness and preferred fit vary, we cannot guarantee that a stated size will fit every pet in the same way.

Pet Safety and Responsible Use

Unless expressly stated otherwise, our pet bandanas, bibs, bows, scarves and decorative neckwear are intended for supervised styling and decorative use only.

• Decorative accessories are not replacements for secure collars, identification tags, harnesses, walking restraints or safety equipment.
• Do not attach a leash to a decorative accessory unless the specific product is expressly designed and described for that purpose.
• Supervise pets while an accessory is being worn.
• Remove accessories during sleep, crate time, rough play, unsupervised activity or outdoor roaming.
• Stop using any item that is torn, frayed, stretched, chewed or has loose components.
• Remove the accessory immediately if the pet shows discomfort, restricted movement, coughing, chewing, anxiety or overheating.

You are responsible for determining whether a product is appropriate for your pet’s size, temperament, health, activity and environment. Seek professional veterinary advice where appropriate.

Orders and Order Acceptance

Placing an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been finally accepted.

We may review an order before fulfillment. We reserve the right to refuse, limit or cancel an order for legitimate reasons, including:

• Product unavailability or inventory error.
• Incorrect product, price, discount or website information.
• Payment authorization failure.
• Suspected fraud, unauthorized activity or abuse.
• An incomplete, invalid or undeliverable address.
• Violation of these Terms or another published store policy.
• Restrictions affecting shipment to the selected destination.

If we cancel an order after payment has been captured, we will issue an appropriate refund to the original payment method, subject to processing times controlled by the payment provider.

Prices, Taxes and Currency

Product prices and available currencies are displayed on the website or during checkout. Prices may change prospectively without notice, but a price change will not normally alter an order that has already been accepted, except where correction is required because of an obvious error or applicable law permits otherwise.

Applicable sales tax, VAT or similar charges may be calculated at checkout depending on the order and destination. International orders may also be subject to duties, import taxes, brokerage fees or customs charges that are not collected by us.

A bank or payment provider may apply currency conversion, cross-border or other financial-service fees. These charges are determined by the relevant institution and are not controlled by Everside Collective.

Payment and Billing Information

You agree to provide current, complete and accurate billing, payment and contact information. You represent that you are authorized to use the payment method submitted with the order.

Payments are processed through Shopify and available third-party payment providers. We do not ask customers to email complete payment card numbers, security codes or account passwords.

A payment attempt may result in a temporary authorization even when an order is not completed. The timing for releasing an authorization is determined by the issuing bank or payment provider.

Order Changes and Cancellations

Requests to change or cancel an order should be sent as soon as possible. We will make a reasonable effort to assist, but we cannot guarantee a change or cancellation after fulfillment, customization, packaging or carrier processing begins.

Customers are responsible for reviewing the selected product, size, color, quantity, recipient name and delivery address before completing checkout.

An order that has already shipped cannot normally be cancelled and must follow the applicable return procedure after delivery.

Processing, Shipping and Delivery

Standard order processing normally takes approximately 1–3 business days. During holidays, promotional events or periods of high order volume, processing may require approximately 3–5 business days.

Many shipments have an estimated transit period of approximately 7–12 business days after dispatch. These timeframes are estimates rather than guaranteed delivery dates.

Delivery can be affected by customs review, weather, carrier capacity, holidays, transport disruption, regional emergencies, address errors and local postal conditions.

You are responsible for providing a complete and deliverable shipping address. Reshipping, address correction or return-to-sender charges may apply when delivery fails because of incorrect information, refusal, unpaid import fees or failure to collect a parcel.

Orders may be divided into multiple shipments. Separate parcels may have different tracking numbers and delivery dates.

Returns, Exchanges and Refunds

Return requests must generally be submitted within 15 calendar days after confirmed delivery. Contact customer care before sending any product back.

Eligible items must normally be unused, unworn, unwashed and in their original condition with applicable tags, packaging and components. For hygiene reasons, products showing pet hair, saliva, staining, fragrance, stretching or other signs of wear may be ineligible.

Customers are generally responsible for return shipping on approved preference-based returns. Original shipping and expedited delivery charges are normally non-refundable unless the return results from our confirmed error or applicable law provides otherwise.

Approved refunds are issued to the original payment method after receipt and inspection. Financial institutions may require additional time to display the credit.

Damaged, defective or incorrect products should be reported within seven calendar days of delivery with clear photographs and the original packaging retained.

Discounts, Promotions and Gift Offers

Promotions may be subject to eligibility requirements, dates, minimum purchase amounts, product exclusions, regional restrictions and other conditions displayed with the offer.

Unless expressly permitted, discount codes cannot be combined with other codes, automatic discounts, bundle offers or sale pricing. Codes must normally be entered before payment and cannot be applied retroactively.

If part of a promotional bundle is returned, the refund may be recalculated to reflect the price of the items retained without the original promotion.

Free gifts, samples and promotional items may be non-refundable and may need to be returned when the qualifying purchase is returned.

Customer Reviews, Images and Other Content

When you voluntarily submit a review, photograph, testimonial, comment, suggestion or other content, you confirm that you have the right to provide that material and that it does not violate another person’s rights.

You grant Everside Collective a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format and distribute submitted content for operating, improving and promoting the store, unless prohibited by law or otherwise agreed in writing.

We may moderate or remove content that is unlawful, misleading, abusive, infringing, irrelevant, fraudulent or otherwise inappropriate. We are not obligated to publish every submission.

Do not submit sensitive personal information, confidential material or images of another person without appropriate permission.

Intellectual Property

Website content, including brand names, logos, product descriptions, original graphics, page layouts, text, photographs and design elements, is owned by or licensed to Everside Collective and is protected by applicable intellectual-property laws.

You may view and use the website for personal, non-commercial shopping purposes. You may not copy, reproduce, modify, republish, distribute, scrape, sell or commercially exploit website content without prior written authorization.

Third-party names, trademarks and content remain the property of their respective owners.

Prohibited Uses

You may not use the website to:

• Engage in unlawful, fraudulent, deceptive or abusive activity.
• Submit false customer, billing, identity or delivery information.
• Attempt unauthorized access to accounts, systems or data.

Website Availability and Disclaimers

Product information does not constitute veterinary, medical or professional safety advice. Customers are responsible for supervising pets and determining whether a decorative accessory is appropriate for a particular animal.

Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be lawfully excluded, including liability arising from fraud, willful misconduct or other matters protected by mandatory law.

To the maximum extent permitted by applicable law, Everside Collective will not be liable for indirect, incidental, special, consequential or punitive losses arising from website use, delayed delivery, third-party services or improper product use.

Where liability may lawfully be limited, our total liability relating to a specific order will not exceed the amount paid for the product giving rise to the claim.

This section does not reduce any mandatory consumer guarantee, statutory remedy or other non-waivable right available in your jurisdiction.

Indemnification

To the extent permitted by law, you agree to be responsible for reasonable losses, liabilities and costs resulting from your unlawful use of the website, your material violation of these Terms or your infringement of another person’s rights.

This provision does not apply where responsibility arises from our own unlawful conduct or where applicable consumer law does not permit such an obligation.

Severability and No Waiver

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A delay or failure to enforce a provision does not waive the right to enforce it later.

Suspension and Termination

You may stop using the website at any time. We may suspend or restrict access where reasonably necessary to protect customers, prevent fraud, maintain security, comply with law or address a material violation of these Terms.

Provisions that by their nature should continue after termination, including payment obligations, intellectual-property provisions, disclaimers and limitations of liability, will remain effective.

These Terms are governed by the laws applicable to the operation of Everside Collective and the relevant transaction, without excluding mandatory consumer protections that apply in the customer’s place of residence.

Before initiating formal proceedings, customers are encouraged to contact us so that we can attempt to resolve the matter directly. Nothing in these Terms prevents a customer from using a court, regulator or dispute-resolution process available under applicable law.

Changes to These Terms

We may update these Terms to reflect changes in our practices, products, website features, service providers or legal obligations.

Updated Terms will be posted on this page with a revised effective date. Material changes will apply prospectively unless applicable law requires a different approach.

Your continued use of the website after an updated version becomes effective constitutes acceptance of the revised Terms, except where additional notice or consent is legally required.

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Information, Returns & Exchanges policy and any additional conditions presented at checkout or with a promotion, form the agreement relating to your use of the website and purchase of products.

If a specific written term presented with a product or promotion conflicts with a general provision in these Terms, the more specific term will apply to that product or promotion to the extent of the conflict.
